Florida Couple Files Law Suit Against Toyota for Injuries Sustained in Accident After Their Recalled Vehicle Was ‘Fixed’

A Palm Beach County couple filed a law suit in Palm Beach County Circuit Court today (Case No. 50-2010CA006853xxxxMB) , against Toyota and Ed Morse Delray Toyota, the local dealership that sold them their 2009 Toyota Camry. Due to the Toyota recall and at the request of the dealer, the Plaintiffs brought their car to Ed Morse Delray Toyota on February 18, 2010, to have the acceleration system fixed. At that time, they were assured that their vehicle was safe to drive and that they would have no other acceleration problems. Eight days later, as they sat at a traffic light in Delray Beach, Florida, their Camry suddenly, and without warning, accelerated into the intersection, causing their vehicle to crash into other vehicles. Both of the plaintiffs suffered serious injuries as a result of the crash.

 

The claims in the law suit include breach of warranties and negligence on the part of Toyota and the local dealership. The lawsuit also alleges that Toyota and Ed Morse Delray Toyota fraudulently concealed the fact that Toyota vehicles had defective acceleration and/or electronic systems.
