Attorneys James Kennedy and Gabriel Berg today announced the formation of Kennedy Berg LLP, a boutique law firm of highly-experienced commercial trial lawyers. Together, in 2010, Kennedy and Berg tried a case against a Berkshire Hathaway company in front of an Omaha, Nebraska, jury and won a directed verdict worth over $ 100 million.* That trial forged a working relationship that led to the formation of this firm.

 

Both Kennedy and Berg have a strong track record of wins representing large and small corporations, entrepreneurs and individuals. Each has faced the most celebrated law firms in the country and won. Andrew Smith, who is currently employed by the Second Circuit Court of Appeals, will join Kennedy Berg as an Associate. The firm is based in New York City.

More About the Attorneys

James Kennedy is an accomplished trial lawyer who has litigated a wide range of disputes before many state and federal courts and arbitration panels. Prior to co-founding Kennedy Berg LLP, he was a member of Kennedy Johnson Gallagher LLC, a litigation boutique he co-founded in May 2004 following 12 years as a partner at Paul Hastings LLP. Kennedys vast experience includes disputes over commercial contracts, real property, fraud, mortgage backed securities, patents, trade secrets and other intellectual property, franchising, restrictive covenants, shareholder rights, partnership obligations, fiduciary duties and securities laws.

 

Kennedy graduated cum laude from St. Johns University School of Law in 1984. He is a former Law Secretary to the Honorable Bernard S. Meyer of the Court of Appeals of the State of New York. He was also employed for several years as an associate at Skadden, Arps, Slate, Meagher and Flom and for two years as an associate and partner at Milgrim, Thomjan & Lee, P.C.

 

Gabriel Berg is also a successful trial lawyer. In courtrooms across the country, he has prosecuted and defended claims for fraud, patent infringement, breach of contract, misappropriation of trade secrets, breach of fiduciary duty, defamation and others. Berg has represented institutional clients, small businesses and individuals in a variety of complex commercial matters.

 

Berg is a graduate of Washington College of Law at American University, and has a B.A. from George Washington University. Prior to co-founding Kennedy Berg, Berg managed the New York office of Berg & Androphy, a Texas-based trial boutique firm. In 2008, he became Of Counsel to Kennedy Johnson Gallagher.

 

Andrew Smith will also join Kennedy Berg in the role of an Associate. Andrew brings experience in both federal and appellate litigation, as well as alternative dispute resolution. Prior to joining Kennedy Berg, Smith was the Attorney Advisor to the Office of Legal Affairs for the United States Court of Appeals for the Second Circuit, where he served as the research and writing clerk for the mediation department and staff attorneys office. In 2009 and 2010, Smith received the Second Circuits Special Achievement Award for his work in the mediation department and his efforts in developing the Circuits electronic filing system.
